1. Our Commitment to Intellectual Property
COCO JOJO LLC ("COCOJOJO," "Company," "we," "us," or "our") respects the intellectual property rights of others and expects users to do the same. This Copyright, Trademark, and DMCA Reporting Policy explains how to report claimed infringement and how COCOJOJO responds.
2. Designated DMCA Agent
In accordance with the Digital Millennium Copyright Act ("DMCA"), 17 U.S.C. Section 512(c)(2), COCOJOJO has designated an agent to receive notifications of claimed copyright infringement. COCOJOJO's Designated Agent is registered with the United States Copyright Office, and current contact information is available through the Copyright Office's DMCA Designated Agent Directory at www.copyright.gov/dmca-directory.
3. How to Submit a DMCA Copyright Notice
If you believe content on our Services infringes your copyright, send a written notice to our Designated Agent containing all of the following, as required by 17 U.S.C. Section 512(c)(3):
- Identification of the copyrighted work claimed to have been infringed
- Identification of the allegedly infringing material and information reasonably sufficient to locate it (e.g., URL)
- Your full legal name, mailing address, telephone number, and email address
- A statement that you have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law
- A statement, made under penalty of perjury, that the information is accurate and that you are the copyright owner or authorized to act on the owner's behalf
- Your physical or electronic signature
4. Counter-Notification
If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notification under 17 U.S.C. Section 512(g) containing: identification of the removed material and its prior location; your name, address, phone, and email; a statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification; consent to the jurisdiction of the appropriate federal district court; and your physical or electronic signature.
5. Repeat Infringer Policy
| REPEAT INFRINGER TERMINATION In accordance with 17 U.S.C. Section 512(i)(1)(A), COCOJOJO maintains and reasonably implements a policy of terminating, in appropriate circumstances, the accounts, distributorships, reseller relationships, affiliate accounts, or other privileges of any user, customer, distributor, reseller, or affiliate determined to be a repeat infringer of copyright or other intellectual property rights. |
6. Trademark Infringement Reports
To report trademark infringement, counterfeiting, or misuse of COCOJOJO marks (or to assert your own marks), send a written notice to support@cocojojo.com with the subject line "Trademark Notice," including: identification of the mark; identification of the allegedly infringing use and its location; your contact information; a good-faith statement; and your signature. COCOJOJO's marks are protected under the Lanham Act (15 U.S.C. SectionSection 1051 et seq.) and California Bus. & Prof. Code Section 14200 et seq. and Section 17200 et seq.
7. False Claims
Under 17 U.S.C. Section 512(f), any person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages, including costs and attorneys' fees.
8. COCOJOJO's Response and Reserved Rights
COCOJOJO will review valid notices and may remove, restrict, or disable access to allegedly infringing content, and may suspend or terminate associated accounts. COCOJOJO reserves all rights and remedies under the Copyright Act, the DMCA, the Lanham Act, the Defend Trade Secrets Act, California unfair-competition law, and other applicable laws, and may seek injunctive relief, statutory and actual damages, costs, and attorneys' fees.
9. Platform Enforcement
COCOJOJO also utilizes marketplace and platform brand-protection programs, including marketplace service providers Brand Registry, eBay VeRO, Walmart Brand Portal, third-party advertising providers and social media platforms IP portals, YouTube Content ID, and similar tools, to enforce its rights against infringement and counterfeiting.
10. Incorporation and Governing Law
This Policy is incorporated into the COCOJOJO Intellectual Property Policy, Terms of Service, and other applicable policies, and is governed by California and U.S. federal law.
