ARBITRATION, CLASS ACTION WAIVER,
| PLEASE READ CAREFULLY - THIS AFFECTS YOUR LEGAL RIGHTS This Policy contains a binding arbitration provision and a class-action and jury-trial waiver. It requires most disputes to be resolved by individual arbitration rather than in court, and waives your right to participate in a class or representative action, except as prohibited by applicable law. Please read it carefully. |
1. Scope
This Arbitration, Class Action Waiver, and Dispute Resolution Policy ("Arbitration Policy") applies to any dispute, claim, or controversy ("Dispute") between you and COCO JOJO LLC ("COCOJOJO," "Company," "we," "us," or "our") arising out of or relating to any product, service, transaction, communication, or COCOJOJO policy, whether based in contract, tort, statute, fraud, or any other theory. It is incorporated into all COCOJOJO policies and agreements.
2. Informal Resolution First
Before initiating arbitration, you agree to first contact COCOJOJO at support@cocojojo.com and provide a written description of the Dispute and the relief sought. The parties will attempt in good faith to resolve the Dispute informally for at least sixty (60) days. This informal-resolution requirement is a condition precedent to commencing arbitration.
3. Binding Arbitration
If the Dispute is not resolved informally, it shall be resolved by final and binding individual arbitration administered by a recognized arbitration provider (such as the American Arbitration Association (AAA) or JAMS) under its applicable consumer or commercial rules then in effect, except as modified by this Arbitration Policy. The Federal Arbitration Act (9 U.S.C. SectionSection 1 et seq.) governs the interpretation and enforcement of this provision.
4. Class Action and Representative Action Waiver
| CLASS ACTION WAIVER TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES SHALL BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS ONLY. YOU AND COCOJOJO WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN A CLASS ACTION, COLLECTIVE ACTION, CONSOLIDATED ACTION, OR PRIVATE ATTORNEY GENERAL ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS OR PRESIDE OVER ANY FORM OF REPRESENTATIVE PROCEEDING. IF THIS WAIVER IS FOUND UNENFORCEABLE AS TO A PARTICULAR CLAIM, THAT CLAIM SHALL PROCEED IN COURT, BUT THE REMAINDER SHALL REMAIN IN ARBITRATION. |
5. Jury Trial Waiver
To the fullest extent permitted by law, you and COCOJOJO waive any right to a trial by jury for any Dispute.
6. Exceptions to Arbitration
Notwithstanding the above, either party may: (a) bring an individual claim in small-claims court if it qualifies; (b) seek injunctive or equitable relief in court to protect intellectual property or confidential information; and (c) pursue any remedy that, by law, cannot be waived or compelled to arbitration. Nothing in this Arbitration Policy prevents you from filing a complaint with a government agency, including the California Privacy Protection Agency, the California Attorney General, or the FTC.
7. Arbitration Procedures and Costs
The arbitration shall be conducted by a single neutral arbitrator. The seat of arbitration shall be Orange County, California, unless applicable law requires otherwise or the parties agree to a different location or to a documents-only or telephonic proceeding. Each party bears its own attorneys' fees except where a statute or the arbitrator provides otherwise. Allocation of arbitration fees is governed by the administering provider's consumer rules; where those rules require COCOJOJO to bear certain consumer arbitration costs, COCOJOJO will do so as required.
8. Opt-Out Right
You may opt out of this Arbitration Policy by sending written notice to support@cocojojo.com within thirty (30) days of first accepting it, stating your name and intent to opt out of arbitration. Opting out does not affect any other provision of the COCOJOJO policies. If you opt out, Disputes will be resolved in the courts identified below.
9. Governing Law and Venue
This Arbitration Policy and any Dispute are governed by California law and the Federal Arbitration Act, without regard to conflict-of-laws principles. For any Dispute not subject to arbitration, the exclusive venue shall be the state and federal courts located in Orange County, California, and you consent to personal jurisdiction there.
10. Survival and Severability
This Arbitration Policy survives termination of any relationship with COCOJOJO. If any portion (other than the class-action waiver, governed by Section 4) is found unenforceable, it shall be severed and the remainder shall continue in full force.
